You recently got married or have been in a common-law relationship and wish to sponsor your non-Canadian spouse/partner for permanent residence. Here are a few red flags that could lead to a refusal, if not explained properly, that you should be aware of when filing the application.
In spousal sponsorship applications you are required to prove to the officer that your marriage or relationship is genuine and not entered into for the purpose of obtaining permanent residence. In many ways, IRCC sometimes has a very traditional way of viewing relationships which can be far from the actual realities of the world. Relationships have modernized quite a lot and come in all different shapes and sizes, however the law places the duty on the Applicant and the Sponsor to convey the nuances of their relationship to the Officer.
The following are some the red flags that you should ideally discuss upfront in your submissions:
· A huge age difference between you and your partner or spouse.
· The length of a relationship: You got married after a short relationship or it was an arranged marriage where you did not explain the circumstances regarding how the relationship was arranged.
· Different background and cultural differences, especially if you began dating online and have a long-distance relationship.
· Lack of proper wedding festivities: your wedding did not follow proper customs and was rushed.
· Different careers and educational backgrounds, couples should explain some common grounds based on which they connect and what attracted them to each other.
· The most important is the status of the spouse and partner being sponsored if they are inside of Canada- whether they have a permit that is expiring soon, they have multiple visa refusals in the past or they are already out of status. The public policy allows for out of status spouses to be sponsored but it needs to be clearly addressed in the submissions.
